摘　　要：石油储备决定着一国的能源安全状况。我国尚未制定有关石油储备管理的专门立法,有关石油储备的管理与执行机关、实施主体、储备的种类与动用、储备项目建设资金等方面的内容,散见于相关政策性文件中,存在诸多亟待解决的问题。美国、日本和欧盟国家有关石油储备管理机构、储备主体、储备品种、储备动用程序、保障措施等方面的经验,可资我国借鉴。完善我国石油储备法律机制,应着重健全石油储备管理体制,明确石油储备的品种和用途,加强政府石油储备管理,建立企业义务石油储备管理制度,完善财税支持机制。Oil reserve determines a country's energy security.Our country has not set specific legislation on the management of oil reserve. The management and enforcement agencies of oil reserve, the implementation body, the types of reserve and use, and construction funds of reserve project, are scattered in related policy files, with many problems to be solved.The related experiences of United States, Japan and EU countries can be imitated by our country.In order to perfect legal mechanism of oil reserve in China,it is necessary to focus on perfecting petroleum reserve management system, clear the varieties and useof oil reserves, strengthen the management of government's oil reserves, establish management system of enterprise oil reserveobligations,and improve the fiscal and taxation support mechanism.
