美国最高院裁决新医改法合宪条件与影响简析  

Brief Analysis Ruling Upon the Conditions of Constitutional about New Health Care Act from the Supreme Court of United States and the Impact under the Ruling

摘　　要：奥巴马签署新医改法后,共和党力图寻求司法途径将其废止。在长期诉讼当中,两党围绕法案争议内容展开了激烈辩论,最后由联邦最高院受理新医改法违宪诉讼案。由于多数大法官支持和社会对新医改需求,以及联邦政府权力扩张等原因。最终最高院裁定新医改法主要内容不违宪,该裁定一方面认可了民主党革新主张,另一方面也满足了共和党限制国会和政府权力诉求,但两党围绕新医改的斗争仍未结束。After president Obama signed Patient Protection and affordable Care Act,the GOP tried to abolish the act by legal proceeding. In the long- term of litigation,there also has a fierce debate over the content of the act between the two parities,and finally the federal supreme court accepted and hear a case that whether the act conform to constitutional. Due to the support from the majority of the justices in the court and the social demand for a new health care reform and the expansion of the federal government power in the field of public affairs,the federal supreme court ruled that the main content of the act was constitutional at last. For one thing,the ruling accept the proposition to reform the health system,for another thing,the ruling met the request that GOP to limit the power from congress and administration,with respect to healthcare reform,the battle between the two parties has stay never been end.
