摘　　要：目的探讨远程医学中医方注意义务的标准,以确定医疗过失的构成。方法通过对远程医学的特点进行分析并借鉴美国一些州的法律规定,探讨应如何确定远程医学中医方的注意义务标准。结果鉴于远程医学与传统医学具有不同的特点,在其运用中应根据具体情况采用不同的医方注意义务标准,需要解决的问题包括对远程医学的界定、这种医疗手段使用的适合性以及在何种情况下应该采取何种注意义务标准。结论在远程医学中,既要限制医方的责任以利于推动远程医学的使用和发展,还应该避免给患者造成不必要的损害。Objective Telemedicine standard of care was discussed to address telemedicine malpractice. Method The standard of care is analyzed based on telemedicine characteristics and laws enacted in some states of USA. Results Given the distinctiveness of telemedicine from the conventional medicine, it is very important to properly define the telemedicine and the situations under which telemedicine should be utilized and, as a result, different standards of care should be designed to accommodate different telemedicine situations. Conclusion Healthcare providers’hesitation should be alleviated to utilize telemedicine and maximize the benefits of telemedicine on one hand. And the risks of telemedicine should be mitigated, on the other hand, for accessible,efficient, cost-effective and convenient healthcare.
