摘　　要：法律方法是法官能动司法的媒介,反映了立法本位向司法本位的转型。它包括法律思维方式、法律解释、法律论证、法律推理等内容。法律方法的媒介作用主要有两点:一是为法官能动司法提供了理论支撑;二是为法官能动司法提供了技术支持。Legal methods are the media of judicial activism,they reflect the transformation from legislative standard to judicial standard. Legal methods include legal thinking,legal interpretation,legal argumentation,legal reasoning and so on. Two main points comprise the intermediary role of legal methods： first,legal methods provide theoretical support for the Judicial Activism; second,legal methods provide technical support for the Judicial Activism.
