摘　　要：网络犯罪中出现的虚拟空间、虚拟财产等问题给传统刑法中的某些概念及其适用范围提出了挑战,也对刑法中关于社会危害性的评价、关于共同犯罪的理论等问题提出了挑战。面对这些挑战,我国既要坚守刑法的基本原理,又要根据网络社会发展的实际,及时调整刑法的应对措施,使传统刑法跟上时代发展的步伐。Concepts of virtual space, virtual property in cybercrime are posing some challenges to the traditional criminal law not only in some of traditional concepts and scope of application, but also in the theory of social harmfulness evaluation and the theory of joint crime. Facing with such challenges, it is necessary for the traditional criminal law to adhere to the basic principle of criminal law, and take correspondingly measures according to the actual development of network society to make the traditional criminal law keep up with the pace of the time＇ s development.
