论代工模式中原始设计制造商的连带责任——以联建科技员工中毒事件为视角

摘　　要：近年来,代工工厂作为一种新生事物,在我国得到迅猛发展,在为我国带来税收和增加就业的同时,也引发了环境污染、员工自杀、中毒、工厂爆炸等一系列严重的社会问题,面对巨额的医疗费用和损害赔偿,仅凭代工工厂从原始设计制造商那里获得的微薄利润难以负担。而按照我国现有法律的相关规定,原始设计制造商在获得超额利润的同时,无须对代工工厂的侵权行为承担法律责任,这显然违背了权利与义务的一致性、公平、诚实信用、公序良俗等法理和民法基本原则。基于此,应当从我国《侵权责任法》第7条着手,适用过错推定原则创制一种新型的特殊侵权类型——代工侵权致人损害;或者从第9条着手,通过帮助行为对原始设计制造商进行连带责任规制,切实维护代工工厂员工的合法权益。In recent years, the original equipment manufacturer as a new thing has made a rapid development in China, when it brings taxes and increases employments for our country, it also results in a series of serious social problems, such as the environmental pollution, employees＇ suicide, poisoning, explosions in the factory, and so on, when the original equipment manufacturer faces a great number of medical care costs and claims for damages, they can＇ t afford only through the profits they get from the original design manufacturer. However, the original design manufacturer needn＇ t bear legal responsibility while they obtain excess profits according to the relevant provisions of China＇ s existing laws, which is clearly against the legal principle of consistency of rights and obligations, the civil law primary principle of fairness, honesty and credit and public order and good customs. Based on this, we should begin with the seventh provision of The Tort Liability Law and create and make a kind of new special tort type through applying to the principle of fault presumption the original equipment manufacturer tort resulting in the people＇ s damages, or start with the ninth, we should put the joint liability on the original design manufacturer through helping behavior so as to protect the personnel＇ s legal rights and interests in the original eequipment manufacturer.
