近代早期英国“诉讼爆炸”现象探析

摘　　要：1560年至1640年是英国社会急剧分化的时期,也是社会关系紧张与纠纷频发时期,诉讼数量呈现史无前例的爆炸式增长。"诉讼爆炸"的形成是近代早期社会经济变迁和法律变革综合作用的结果。"诉讼爆炸"并没有引发社会失序,反而有助于化解纠纷和维持社会秩序,为近代早期英国社会转型提供保障。"诉讼爆炸"不仅对法庭官僚机构和法律职业者带来重要影响,而且作为国家"扩散性权力"的来源推动近代国家的形成。因此,透过"诉讼爆炸"可为我们研究英国社会转型和了解近代早期英国社会形态提供新视角。From 1560 to 1640,the British society underwent a period of polarization,tensional social relationship and frequent disputes. The formation of lawsuit explosion was under the comprehensive influence of early economic change and law revolution. It not only exerted important influence upon court organizations and people engaged in the law profession,but also promoted the formation of modern country as the source of diffusive power. Therefore,the lawsuit explosion offers a new abgle for us to study the social form and transformation in the early periods of Modern Britain.
