知识产权公共政策体系的理论框架、构成要素和建设方向研究

摘　　要：我国知识产权公共政策有力促进了知识产权事业发展。主要的知识产权强国均以促进知识产权资源发挥比较竞争优势为方向,构建完善的知识产权公共政策体系。我国知识产权公共政策存在协调性、实操性和系统性不高等问题,尚未形成体系。结合我国国家创新体系、产业政策体系、贸易强国政策体系等公共政策体系经验,提出我国知识产权公共政策体系理论框架。我国知识产权公共政策体系的内涵应当从主体、要素与环节三维度建构,外延包括本体政策、关联政策和支持政策。我国知识产权政策体系性不强的主要原因是本体政策层次不高和关联政策内容不深。建议加强在规划、法律层面部署本体政策;以促进创新成果产权化、知识产权产业化、知识产权产业贸易化为方向深化关联政策。China＇s intellectual property public policy effectively promote the development of intellectual property industry. The intellectual property public policy systems are established to develop competitive advantages with intellectual property resource in developed countries and areas, such as Japan, South Korea, Singapore, Europe Union and the United States. The intellectual property public policy in China is still lack of coordination, maneuverability and systematicness. Based on the experience of building state innovation system, industrial policy system, and power trading nation policy system, this article proposes the theoretic model of intellectual property public policy system. The intellectual property public policy system contains principal parts, elements and links, including noumenal policy, associated policy, supported policy. The main reason of lack of systematicness of our intellectual property public policy is that the level of noumenal policy is low and the content of associate policy is superficial. It is proposed that the noumenal policy should be arranged by plan and law and the associate policy should take the advancement of innovation propertilization, intellectual property industrialization and intellectual property industrial commercialization.
