摘 要:《社会救助暂行办法》的实施,结束了我国社会救助制度"碎片化"的局面。社会救助作为维护公民基本尊严的托底制度,理所当然需要严格监管。"张海超事件"的后续发展暴露出当前我国社会救助中的监管机制存在着审查标准不够细化、执行程序过于简单、救济程序不完善等问题。《社会救助暂行办法》作为临时性法律,只是从宏观层面上完成了社会救助的笼统性规范,却无法进行具体规制。为了更好地实现救助目的,维护社会稳定,保障人权,民政部门有必要通过行政立法对《社会救助暂行办法》进行相关制度配套,从而完善我国社会救助中的监管制度。The implementation of Provisional Measures for Social Assistance has put an end to 'fragmentary'situation of the social assistance system in China. As an underpinning system to uphold citizens' basic dignity,social assistance should naturally be placed under strict supervision. The follow-up development of 'Zhang Haichao incident',however,has revealed deficiencies in current China's supervision mechanism for social assistance such as unrefined scrutiny standards,oversimplified executive procedures,and imperfect relief proceedings. To better fulfill the purpose of assistance,maintain social stability,and protect human rights,civil administration departments should,through legislation,make related matching systems to Provisional Measures for Social Assistance so as to improve China's supervision and management of social assistance activities.
