摘　　要：高校校名屡被他人非法使用,即便高校普遍注册校名类商标也难以遏制,于是不少高校希望借助驰名商标的特殊保护机制来维护校名权益,但这得先解决高校商标认驰中的观念差异、立法障碍和执法困惑问题,才能建立起保护高等教育公共利益的驰名商标法律制度。University names are always abused illegally, even after the names are registered as trademarks. To protect their interests and rights, universities hope to resort to the special renowned trademark protec- tion mechanism. However, the problems concerning conceptual differences, legal barrier and execution dif- ficulties in the trademark protection mechanism must be solved before the renowned trademark protection system for the public interests of university education is established.
