摘 要:当前,我国法律边疆地区的制度结构依然是正式制度与非正式制度构成的二元结构,对该地区的刑罚运行构成了明显的制约。以民族国家理论为基础而形成的刑罚压制思维过于强调正式制度的作用,无法在正式制度与非正式制度之间建立有效联系,进而使正式制度无法有效展开,因而应当受到清理。以刑法谦抑主义为理论基础的刑罚治理思维,强调正式制度与非正式制度之间的有效对接,不仅能够有效解决刑事冲突,而且有利于增强正式制度的合法性基础,因而应当得到提倡并且能够通过建立商谈与妥协理论得到贯彻。At present,the institutional structure in China's legal border areas is still dual structure consisting of formal system and informal system,w hich constraints the penalty 's performance significantly in this area. The repressive thinking of penalty,w hich is based on nation-state theory,emphasizes the role of formal system too much,so can not establish effective linkages betw een formal system and informal system,and results that the formal system can not be carried out effectively. Therefore,this thinking method should be cleaned up. The governance thinking of penalty,w hich is based on modesty of criminal law,emphasizes the effective docking of formal system and informal system,so not only can solve criminal conflicts effectively,but also helps to enhance the legitimacy of formal system. Consequently,this thinking method should be advocated,and can be put into effect by establishing 'negotiation and compromise'theory and applying the principle of guilt.
