澳大利亚奥林匹克知识产权保护制度评介及启示

摘　　要：采用文献资料法和逻辑分析法,阐述了澳大利亚奥林匹克知识产权的立法和修改完善情况,认为澳大利亚奥林匹克知识产权保护具有五个特征:奥林匹克标志保护范围广且力度强;法律明确规定澳大利亚奥林匹克知识产权的权利人;通过引入"合理人"制度来判断合理使用和侵权行为;独立的法律救济方式;悉尼奥运组委会采取一切措施营造奥林匹克知识产权保护氛围。指出,我国应借鉴澳大利亚奥林匹克知识产权保护经验,加强我国体育赛事知识产权的法律保护,提高我国体育赛事知识产权保护的法律位阶,将《特殊标志管理条例》《奥林匹克标志保护条例》等行政法规修改完善为《特殊标志保护法》,建立我国体育赛事转播权保护的法律体系。By methods of literature and logic analysis, this article demonstrates the legislation and modification of Australian Olympic intellectual property rights. This article proposes that the Australian Olympic intellectual property protection has five characteristics： first, the protection of Olympic Symbol is wide-ranging and tough; second, the law clearly stipulates the obligees of the Australian Olympic intellectual property rights; third, legal use and infringement are judged through the introduction of ＂reasonable person＂ system; fourth, it has independent legal aids patterns; fifth, Sydney Olympic Organizing Committee has been taking every method to create an atmospherethe for Olympic intellectual property protection. This article points out that our country should learn from the experience of the Australian Olympic intellectual property protection, to strengthen the legal protection of intellectual property right of sports Games, improve the legal hierarchy of Chinese sports~ intellectual property protection, reviseand upgrade ＂Regulations on the Administration of Special Signs＂ and ＂Regulations on the Protection of Olympic Symbol＂ into ＂Law of Special Signs Protection＂, establish a legal system of sports broadcasting right protection.
