消防执法的正外部性及其制度激励

摘　　要：消防执法作为典型的公共物品,具有较强的正外部性。消防执法的正外部性源自于有限理性、公共物品属性、政府俘获以及制度的非科学性与欠完善性等基本因素,具有广泛而多样化的功能。消防执法正外部性决定了法制激励的必要性,具体包括了树立实质正义、社会本位、整体效益的价值理念以及主干制度建设两个层面。As the typical public goods,the fire control law enforcement has strong positive externalities.Originated in limited rationality,public goods attribute,the public goods attribute,the state capture theory and the unscientific and imperfection of legal system,the positive externality of fire control law enforcement has various functions.Its externalities decide the necessity of the legal system incentives.It includes a series value,including the substantial justice,the social standard,the overall efficiency,and the construction of main legal systems.
