韩国犯罪论体系形成的启示

摘　　要：20世纪80年代韩国通过精通德语的学者们的贡献直接将德国的刑法理论引进到韩国的刑法体系中。目前,韩国的犯罪论体系采取的是新古典·目的合一的犯罪论体系。德国犯罪论体系对韩国犯罪论体系的形成和发展产生了重要作用。韩国刑法学借鉴了德国犯罪体系上的特殊理论,形成了系统的犯罪论体系。加强对韩国借鉴德国犯罪论体系理论基础的研究,对于把握德国犯罪论体系的全貌和发展规律,促进完善中国的犯罪论体系具有重要意义。In the 80s,the Germany criminal law theory was introduced directly to the criminal law system of Korea by the Korea scholars who were proficient in German. At present time,the Korea＇ s crime theory system is the unity of the neoclassical and the objective theory of crime . This paper discusses four parts. In the first part, the paper introduces the basic change process of the German criminal theory system, which has a decisive influence on the formation of Korea＇ s criminal theory system. In the second part,the paper elaborates the development of the Korea＇ s criminal theory system and the influence of the German criminal theory system in its development. In the following parts, the paper presents the special theory and effects of the German criminal theory system drew by the Korea＇ s crime theory system and the enlightenment to the Korea＇ s crime theory system. For the purpose of understanding the panorama of the German criminal theory system and promoting the Chinese criminal theory system, it is signifi- cant to further the study of the theoretical basis of Korea in learning from German criminal system.
