中国近代的法官回避制度

摘　　要：近代以来,为了维护司法中立,促进司法公正,各届政府纷纷制定相关的法律法规,要求法官在任职、执行职务等活动过程中,必须避开某些地域、亲属或退出审判活动,从而形成了近代意义上的法官回避制度。包括职务回避、地域回避和任职回避在内的近代法官回避制度在保障诉讼程序的公正、防止司法出现地缘化和亲缘化倾向等方面起到了一定的作用。由于制度设计上存在诸多问题,制度的执行缺乏应有的保障,从而导致近代法官回避制度的价值未能真正实现。Since modem times, judges avoidance system came into being gradually in order to preserve judi- cial neutrality and produce judicial justice. Judges avoidance system was defined that judge must avoid cer- tain place, certain relatives or withdraw from iudicial activity. The system included trial avoidance, region avoidance and so on, which played a part on ensuring procedural justice and prevent influence from interper- sonal relationships and geo - relationship. The system is a reference to our contemporary judges＇ avoidance system. The value of judges＇ avoidance system can＇t be realized because of the problem in system design and system implementation.
