国家治理体系下的地方政府权力重构

摘　　要：国家治理体系作为全面深化改革的总目标,对地方政府权力的配置模式将产生体系性影响。"多中心治理主体"、"合作式治理模式"需要发挥不同社会主体在国家治理和社会发展中的作用,而在地方政府职责中应更加强调服务职能的完善。所以在地方政府权力的横向配置中,要求重新划分政府与社会、市场间的权力范围,并且推动三者间关系的法治化。但是当前各级地方政府间"上下同责"、"上下同粗"的权力体系严重阻碍了地方政府权力的多中心横向配置,所以各级地方政府间的纵向分权以及增强基层政府的自主权成为地方政府权力重构的首要任务。此外,国家治理体系对行政法学的基本原则也产生了深远影响,在新时期地方政府权力配置法治化的道路上,应更加强调监督和制约地方政府行政权的行使,防止各级地方政府恣意逾越横向、纵向的权力边界。因此,法律保留原则和越权无效原则的价值将会更加凸显,而相关立法也应当更加完善。Sate Governance System, an ultimate goal of the comprehensive and deep reform, has a great influence on local governments’ power configuration. “Polycentric governance body” and “cooperative governance” require that all social units play a more important role in the State Governance System and social development. Moreover, in local government responsibilities, service function should be more emphasized. Therefore, it requires to redraw the power structure among government, society and market, then promote the rule of law of their relationship in the transverse configuration of local government powers. Therefore, in the lateral configuration of local governments’ power, it is required to re-divide the power between the government, society, and market, and promote the legalization of the relationship between the three. However, the present power system of “sharing the equal responsibility and equal power between the superior and the subordinate”has greatly hindered the multicenter lateral configuration of local governments’ power. Therefore, the vertical power separation between the local governments at all levels and enhancing the government＆#39;s autonomy at the local level have become the primary task of the reconstruction of local governments’ power. In addition, the State Governance System also has a great influence on the basic principles of administration law. In the new era, it should be stressed to restrict the abuse of local government powers and prevent local government wantonly breaking up the boundary of powers under the rule of law of local government power configuration. Moreover, the principle of legal hold and ultra vires invalidity will be more valuable and relevant legislation will be more perfect.
