《军人保险法》立法的若干问题分析

摘　　要：《军人保险法》是一部以立法确认军人保险制度的法律,为建立科学、规范的有中国特色的军人保险制度体系提供了法律保障。但是不可否认,《军人保险法》并非尽善尽美,仍存在进一步完善之处。因此,有必要对其中的立法依据、立法前瞻性、基金与监督在总则中的缺失及法律救济的设定等立法问题进行深入分析研究。The law of military insurance establishes basic framework of the military insurance system and provides legal protection for establishing scientific, standardized system for military insurance system with Chinese characteristics. But there is no denying the fact that the law of military insurance is not perfect. The law needs improvement. This paper analyzes the logic, the legislative prospectiveness, the absence of fund and supervision in the general and the definition of legal relief.
