浅谈博客作品的法律保护问题

摘　　要：秦涛诉搜狐一案被称为"中国博客著作权第一案",引发了博客作品创作者维护著作权的热潮,博客作品著作权的保护也成为法学界研究的热点。对比国内外的相关立法、保护现状和存在的问题,应当强化集体管理、合理使用制度,建立默认许可制度,改善网站的自律性和制度建构以更有效地保护博客作品著作权。Qin Tao against Sohu, a case known as ＂China＇s first case of blog copyright＂, triggering a boom of the blog authors copyright, make blog copyright protection become the focus of academic research. Comparison of domestic and in- ternational legislation, the status quo and existing problems, collective management and fair using system should be strengthened, and establishes a default licensing system to improve self-discipline and system construction of the web site to more effectively protect blog copyright.
