宋代司法公正的制度性保障及其近世化趋向

摘　　要：司法活动欲实现为社会运送正义的价值目标,必须首重制度设计。宋代司法传统中的一系列制度,不仅使仁爱司法理念得到践行、法官职业素养得到提升,而且还使司法制衡机制得到强化,审判程序设置更加精密,司法辅助制度更加完善。这些举措是宋代司法公正得以实现的重要保障,也是宋代司法文明的重要标志。宋代司法文化的这种整体性突破与结构性优化,折射出了宋代司法传统的近世化转型趋向,有着深刻的历史成因和重大的理论与现实意义。In order to transmit justice to the whole society, the judicial activities must pay more attention to the system design firstly. There was a series of systems in the judicial tradition of the Song Dynasty, which not only fulfilled the kindhearted justice idea, but also promoted the iudge professionalism, strengthened the iudieial balance mechanism, refined the trial procedure, and improved the judicial assistant systems. These measures not only played an important role in realizing judicial justice, but also was an important symbol of judicial civilization of the Song Dynasty. These integrity breakthrough and structural optimization, which reflected an early modernization transformation trend of judicial tradition in the Song Dynasty, had profound historical causes and important theoretical and practical significance.
