摘　　要：批复是最高人民法院司法解释的形式之一。法律解释方法在其中的运用值得研究,包括文义解释法、体系解释法、历史解释法、目的解释法以及社会学解释法等各种法律解释方法在最高人民法院批复中都采用过。最高人民法院批复工作的严谨和专业程度是值得肯定的,但批复中法律解释方法的运用仍存在有一定的缺陷,如法律解释方法运用得不够清晰,个别批复中法律解释方法的缺失等。通过强化法律解释方法的运用,推动最高人民法院批复工作的发展,是必要的,也是可行的。Reply is one of the forms of the Supreme People＇s Court＇s judicial interpretation. It＇s worthy of stud- ying on the application of Legal Interpretation Methods on the Supreme Peopleˊs Court Reply,which include the methods of literal interpretation,system interpretation,historical interpretation,object interpretation method and sociological interpretation. Supreme People＇s Court should be praised for their rigorous and professional attitude manifested in the work of the reply. However,judicial interpretation activities of the Supreme People＇s Court have some drawbacks,Such as the application of legal interpretation methods wasn＇t clear enough and the lack of legal interpretation methods in certain replies. It＇s not only necessary,but also feasible to improve the work of the Supreme People＇s Court Reply through strengthening the application of Legal Interpretation Methods.
