论罚金刑易科在我国之适用

摘　　要：在当今世界,罚金刑的广泛运用体现了刑罚轻缓化的趋势,受此影响我国罚金刑的应用范围也越来越广。但是与此相对应的是罚金刑"空判"现象普遍存在,这严重影响了罚金刑作用的发挥。为了解决这个问题,世界各国纷纷采取应对措施,其中罚金刑易科就被认为颇有成效。我国为解决罚金刑执行难的困境,也可以适用罚金刑易科。In the world today, fine penalty is widely used, which embodies mitigation of criminal penalty. Influenced by this tendency, fine penalty has been applied in a wider scope in China. But ＂ uselessness＂ phenomenon of fine penalty is widespread, which seriously affects the function of fine penalty. In order to solve this problem, different countries in the world has taken various countermeasures one after another, among which exchanged fine penalty is generally recognized as greatly effective. In China, exchanged fine penalty can be applied for the purpose of solving the trouble of execution of fine penalty.
