摘　　要：我国的法治化建设整体飞速发展,然而作为思想和学术前沿的高校,在学生处分制度的法治化方面却相对滞后。高校学生处分程序不规范现象的存在,既损害了学生的合法权益,也使高校的学生处分权行为的合法性受到置疑。为了减少和避免学生与学校间的处分纠纷,保证学生的合法权益不受侵犯,提高高校学生管理水平,需要从法律的角度出发,规范处分行为,维护大学生的合法权益,加快推进高校依法治校进程。The construction of the government by law is on a rapid development road. However, as the thought and academic frontiers of colleges and universities, in terms of student disciplinary system under the rule of law is relatively lagging behind. The existence of university students' disciplinary procedure is not standard phenomenon, damage the legitimate rights and interests of the students, both makes the legitimacy of the college student affairs office of the decentralized behavior by doubt. In order to reduce or avoid punishment dispute between school and students, guarantee the legitimate rights and interests of students are inviolable, improves the management level of the college students, need from the perspective of law, regulate the behavior of punishment, safeguard the legitimate rights and interests of students, and accelerate the process of college administration.
