摘　　要：职工董事制度是国有企业构建和谐劳动关系的重要制度创设。国有企业职工董事制度在实践中存在的一些问题,弱化了职工参与公司治理的法律地位。借鉴德国职工参与公司治理的法律制度,加强国有企业职工董事制度建设显得非常重要。The employee director system is the creation of an important system to build harmonious labor rela- tions in state-owned enterprises.
