摘　　要：军营法律文化是军营这一相对封闭的"亚社会"在长期军事实践活动中逐渐形成的,对法律所特有的思想观念、理想人格、情感倾向、行为趋势,即关于权利与义务的价值模式和行为模式的总和。它不仅是一种具有实体内容和对象的文化结构,更是一种用文化的眼光认识军营法律现象的思维方式和研究方法。它与现代法治理念存在着冲突与互动,与军营法律传统呈现出继承与变革的关系。因此,我们应当普及先进的军事法律理念、完善军事法律制度和规范、提升军事法律组织的效能,为建立符合现代法治理念的军营法律文化奠定基础。The legal culture in army camps is a relatively closed sub-society, which is gradually developed through a long period of military practice and covers all unique legal factors, including ideology, ideal personality, emotional tendency and behavior tendency. In other words, it is the sum of value and behavior model about rights and obligations. In fact, it is not only a kind of cultural structure containing concrete content and objects, but also a kind of thinking mode and research method that help understand legal phenomena from the cultural point of view. Objectively speaking, there are conflicts and reactions between legal culture and modern ideas of the rule of law, and there is relationship of inheritance and development between legal culture and legal tradition in army camps. Therefore, we should popularize advanced military legal ideas,improve the military legal systems and regulations, and enhance the effectiveness of legal organization so as to lay the foundation for creating military legal order that conform to modern ideas of the rule of law.
