摘　　要：通过调研发现网络交易中专利侵权案件数量大、特点新、处理难,仅依靠网络交易平台商难以遏制专利侵权,企业呼吁与行政机关共建对接处理机制。但我国法律制度中缺乏电子商务领域专利侵权责任的专门规定,且专利行政执法权限小、措施少,行政机关介入电子商务领域处理专利侵权纠纷有心无力。建议完善相关法律规定,借鉴浙江省电子商务专利侵权纠纷处理机制的经验,构建电子商务领域专利保护协作机制,促进电子商务产业健康有序发展。Through investigation, we found a lot of patent infringement problems in E - commerce with the features of large quantities, new characteristics, and great difficulty. E - commerce enterprise is difficult to deal with these cases independ- ently, and they need government＇ s cooperation. But our country＇s laws are lacking patent infringement liability in electronic commerce, and the patent administrative law enforcement is short of authority and measures. The law enforcement agency has no strength to deal with it. So we suggest as follows ： perfecting relevant laws, learning from the experience of Zhejiang, building e -commerce patent protection coordination mechanism, and promoting the healthy and orderly development of the e - commerce industry.
