论深化体育改革对体育现代治理的法治依赖  

On the legal dependence of deepening sports reform on sports modern administration

摘　　要：党中央相继做出全面深化改革、推进治理现代化和全面推进依法治国的战略部署,形成了对深化体育改革与推进体育现代治理中进一步加强法治体育建设的刚性需求和强劲动力。在分析深化改革、现代治理与法治建设关系的基础上,提出深化体育改革应着眼于体育治理的现代化和法治化,从目标、途径和保障的视角论证了建设法治体育在体育改革与治理中的主导地位,结合体育改革发展的实际,就改革体育行政部门法治作为、维护各类主体体育权利、建立体育社会化法治机制、加强体育产业法治调控、扩大多元化体育法治服务等方面提出深化体育改革与治理的建议。The Party Central Committee has successively made strategic deployment for comprehensively deepening reform, boosting administration modernization and comprehensively boosting country ruling by law, which had formed the rigid need and strong power for further strengthening legal sport construction in deepening sports reform and boosting sports modern administration. Based on their analysis of the relationship between reform, modern administra-tion and legal construction, the authors put forward that sports reform should focus on the modernization and legaliza-tion of sports administration, demonstrated the leading status of constructing legal sport in sports reform and admini-stration from the perspectives of targets, ways and assurance, and proposed to, according to the reality of sports reform development, deepen sports reform and administration in such aspects as reforming sports administration departments’ law enforcement behaviors, protecting various subjects’ sports rights, establishing a legal mechanism for sports sociali-zation, strengthening sports industry legal regulation and expanding multi-dimensional sports legal service.
