无证公共场所与卫生监督部门的博弈分析

摘　　要：近年来公共场所无证经营现象大量出现,已经成为城市管理的难点问题之一。公共场所无证经营者追逐自身利益最大化与代表政府监管的卫生监督部门之间存在着博弈。通过构建博弈模型分析得出结论,为降低公共场所无证经营行为概率,应采取疏堵结合的方式,具备条件的督促办理卫生许可证,不具备条件且屡教不改的,加大处罚力度,会同相关部门予以取缔。同时要加强卫生稽查工作,对监管不力的监督人员给予一定处罚,最终彻底杜绝公共场所无证经营行为。Recently,the proliferation of unlicensed business activities in public places became one of the difficult points in China.A game relationship existed between the unlicensed business aimed at profit-maximization and health supervision departments.The analysis showed that,a comprehensive approach should be adopted to reduce the probability of unlicensed business activities,namely,those businesses with the required conditions ought to obtain the required license,on the contrary,those without proper conditions and incorrigible should be ensured severe punishment or banned.For the sack of cleaning up unlicensed business activities in public places,the government should enhance supervision,and inspectors who neglect or dereliction of duty ensured penalities in accordance with laws and regulations.
