摘　　要：在夫妻财产关系的法律适用问题上,理论及实务界大多关注夫妻之间内部财产关系的法律适用,往往忽视夫妻与第三人之间的外部债权债务关系的法律适用问题。正确把握夫妻财产关系法律适用的空间及时间范围,不仅是科学进行法律适用分析的内在要求,而且有助于保护善意第三人的利益。夫妻财产关系法律适用的范围并不扩及于夫妻对外债权债务问题,在处理与第三人债权债务相关的夫妻财产纠纷时应根据该债权债务关系自身的性质确定准据法。In the matter of the applicable law of matrimonial property relationship,the law applied in internal property relationship between husband and wife has usually absorbed more attention in theory and practice field than the law applied in external claims and liabilities between the couple and a third party.Correctly defining the spatial reach and time horizon of the applicable law in matrimonial property relationship is not only the intrinsic requirement to apply the law scientifically,but also conducive to protect the interest of a third party with good faith.The scope of the applicable law of matrimonial property relationship does not extend to the couples' external claims and liabilities.The applicable law should be determined according to its own character of the debtor-creditor relationship when dealing with the property dispute between a couple and a third party.
