论气候有益技术转让的国际法律协调制度的构建——兼论中国的利益和应对

摘　　要：促进气候有益技术尽快在全球范围内推广和应用是应对气候变化的关键所在。近期的纽约全球气候峰会为2015年在巴黎达成气候变化新协议凝聚了政治动力,但在与气候变化密切相关的资金和技术转让问题上并没有达成互信和共识。长期以来,气候有益技术的国际转让面临转让不利的困难,尤其是向发展中国家的技术转让存在较大障碍。从国际法制角度看,这种困境之根源在于相关国际立法之间存在利益难以协调甚至难以实现的问题。文章基于市场范式下气候有益技术转让相关国际立法的法律经济学分析,结合康德生态范式和现有国际实践的动态思考,探讨构建气候有益技术转让之国际法律协调制度的必要性、可能性及初步设想。中国应当在国际社会提出气候有益技术转让国际法律协调制度的构想,并改善国内技术立法和知识产权立法,以便为中国发展气候有益技术提供良好的国际和国内环境。The advancement of worldwide popularization and application of climate-friendly technology transfer is the key to the respond to climate changes. Recent global climate summit in New York condensed political power for a new climate change agreement in Paris in 2015, but did not reach a consensus on funding and technology transfer closely related with climate changes. Adverse difficulties have faced international climate-friendly technology transfer for a long time, especially technology transfer to developing countries. From a perspective of international law in- stitutions, the root of this difficulty lies in the hardness of interests coordination among interna- tional legislation and even interests realization. Based on market paradigm, legal economic analy- sis of international legislation concerning climate friendly technology transfer combines dynamic thinking of Kant＇s ecological paradigm and current international practice, and discusses the ne- cessity, possibility and preliminary design of international legal harmonization system concerning climate friendly technology transfer. China should propose the idea of international legal harmoni zation system concerning climate friendly technology transfer to the international society and im- prove domestic technology legislation and intellectual property legislation to provide sound international and domestic environments for the development of climate friendly technology.
