摘  要:在WTO服务贸易争端中,系争服务是否属于成员减让表所列之某一服务部门,决定了成员是否对该服务做出了承诺。中国电子支付服务案中,专家组在WTO历史上首次引入"促成服务"概念,以界定服务部门的范围,并首次引入"产业资讯"以探求词语的"通常含义",却未参考谈判基础文件。其强调适应商业现实的"目的与宗旨"解释同样值得关注。WTO裁判机构应谨慎对待通过条约解释处理服务分类体系与商业现实之间的脱节,应由成员谈判达成对服务分类体系的新共识,以适应不断变化之商业现实。The classification of services is one of the critical issues for WTO cases of conflicts in services. Whether the service at issue falls within any service sector committed in a member's schedule decides whether the member has made the commitment. The interpretation developed by the panel in China-EPS puts forward the issue worthy exploring. For the first time in the WTO's history, the panel introduced the concept of "enabling services" to define the scope of a service sector, and invoked "industry sources" to explore a term's "ordinary meaning" while disregarding the W/120 document and the CPC completely. Also noteworthy is the way in which the panel reads the "object and purpose" of the GATS and the WTO Agreement. The DSB should be very cautious to deal with the gap between current service classification system and commercial reality through developing interpretation techniques, and should be very careful to maintain the consistency of jurisprudence.
