摘 要:我国的监护制度主要是针对未成年人和精神病人而设计,对于行为能力受限的老年人的监护,《民法通则》等相关法律并未规定。随着我国逐渐步入老龄化社会,老年人的监护和养老问题不仅是一个社会问题,更是一个法律问题。新修订的《老年人权益保障法》第26条将监护扩充至所有全部丧失或者部分丧失民事行为能力的老年人,是立足于我国老龄化的社会现实,初步构建、完善我国的成年监护制度的设想,即首先在立法上加强对老年人的监护。但是,要完善我国的成年监护制度,还必须在肯定此法规定的基础上,不断创新监护的方式,在利用信托这一极具灵活性制度的基础上,促进我国成年监护制度的改革,以专业的信托机构作为受托人,构建具有中国特色的老年人监护信托制度,以期能为将来民法典编纂过程中的监护立法抛砖引玉。In China,guardianship system is mainly designed for the juvenile and the mentally disabled. However,there is no clear legal provision in China's General Principle of the Civil Law for the guardianship of the old-aged(who had no or limited capacities). Along with the graying of Chinese society,old-aged guardianship and supporting system is becoming both a social problem and a legal problem. Article 26 of the newly revised Law on Protection of Rights and Interests of the Elderly expanded the object of guardianship and supporting to all the elderly people who lost or partially lost capacity for civil conduct.Strengthening the guardianship of the elderly in legislation is the first step for China to construct and complete the proposal of adult guardianship system. However,in order to perfect the adult guardianship system,new guardianship methods should be created to reforms such system. In the flexible guardianship trust system,professional guardianship institutions serve as trustees,which will contribute to the construction of elderly guardianship system with Chinese characteristics. We hope that this study will contribute to the legislation of guardianship system.
