论国际中转集拼业务中的过境货物知识产权海关保护——兼论欧盟知识产权海关执法带来的思考和启示

摘　　要：上海港国际中转集拼业务的蓬勃开展,对集装箱货物运输,以及与之相关的国际货物贸易的其他领域,提出了新的问题和挑战。是否应当,以及应当如何针对过境货物采取相宜的知识产权保护措施,即其在国际货物贸易有关的知识产权领域的具体表现。对此,或可以以欧盟知识产权海关执法及其实践情况为样本,结合相关的欧盟立法和司法实践,并依据GATT和TRIPs等WTO法律制度中的具体规则,取其精华去其糟粕,为上海港国际中转集拼业务中的过境货物知识产权海关保护提供参考和借鉴。The robust development of the international transit freight consolidation in Shanghai ports poses new problems and challenges in the transport of containerized cargos as well as in other fields related to international trade in goods. Therefore, it is advisable to learn from the IPR Customs enforce- ment in EU on the basis of EU legislation and judicial practice and take into account the WTO rules of GATI＇ and TRIPS, so as to provide reference to IPR Customs protection for the transit goods in the inter- national transit freight consolidation in Shanghai ports.
