摘　　要：行政自由裁量权是行政机关开展行政管理和行政执法的关键内容和核心问题。作者简要阐释了行政自由裁量权的含义及其存在的必要性,并从卫生行政处罚角度就其所存在的问题进行分析,提出对策和建议,以期提高卫生执法水平、规范卫生处罚行为。The administrative discretion is the key content and the core problems of administrative law enforcement and administrative management. This article briefly illustrates the meaning of administrative discretion and its necessity, analyses the problems existing in the discretion from the angle of health administrative penalty, and put forward the countermeasure and the suggestion, in order to improve the health level of law enforcement, regulate the behavior of health penalty.
