民族乡自主权与民族区域自治权概念比较

摘　　要：民族乡自主权与民族区域自治权作为一种公权力,是我国特殊国情下地方自治权力的一种特殊表现,是我国权力体系的一个环节,在立法背景、理论依据、权力属性等方面有着诸多相同之处。虽然二者同根同源,根植于我国民族区域自治的理念,但由于权力的载体不同,在行使机关、法律渊源、权限以及效力四个方面的内涵也发生着变化。As a kind of public power, township autonomy and ethnic regional autonomy are a special manifestation of local self - government power under special circumstances as well as a link of our country＇s power system, and they have much common in the aspects of legislative background, theoretical basis and the properties of power. Although they share the same origin, rooted in the concept of ethnic regional autonomy of our country, they vary in the aspects of exercising agency, legal resource, authority and effectiveness because of the difference of carriers of power.
