国土资源行政复议工作应当坚持政治性、人民性和法治性的有机统一

摘　　要：党的十八届三中全会指出要改革行政复议体制,健全行政复议案件审理机制,纠正违法或不当行政行为。本文以推进工业化和新型城镇化建设、全面建设小康社会为背景,系统论述了新形势下做好国土资源行政复议工作应当坚持政治性、人民性和法治性的有机统一。为进一步阐明政治性、人民性、法治性的具体内涵,本文结合国土资源行政复议工作有关土地、矿产典型案例,进一步对坚持政治性、人民性、法治性需要处理的几大关系进行论述,认为坚持国土资源行政复议工作的政治性应妥善处理政策和法律的关系、依法行政和改革创新的关系、个案正义和社会正义的关系;坚持行政复议工作的人民性要正确认识和处理行政监督和维护权益的关系、行政主导和公众参与的关系、合法性审查与合理性审查的关系;坚持行政复议工作的法治性应正确认识和处理程序公正和实体公正的关系、依法审理和妥善调处的关系、法律效果和社会效果的关系。Under the new situation,land and resources administrative reconsideration should adhere to the unity of political popular and the nomocracy.Adhering to political should properly handle the relationship between policy and law,the relationship between administration according to law and innovation,and the relationship between individual justice and social justice;adhering to the popula should properly handle the relationship between administrative supervision and maintenance of the rights and interests,the relationship between administration and public participation,and the relationship between legitimacy examination and rationality examination;adhering to the nomocracy should properly handle the relationship between procedural justice and entity justice,the relationship between trial and mediation,and the relationship between legal effect and social effect.
