WTO体制下单边NPR-PPMs措施的合理性及制度设计

摘　　要：随着国际社会对环境保护的愈发重视,在WTO体制内掀起了"绿化"WTO的浪潮。发达国家主张实施单边NPR-PPMs措施以顺应环保潮流。但是由于这种措施的单边性、域外性和歧视性,其合理性遭到了质疑。发展中国家指责发达国家以环境保护为名行贸易限制之实。NPR-PPMs标准本身是有合理性的,其负面影响主要来自于贸易实践中的滥用行为,为改变发展中国家对单边NPR-PPMs措施的误解必须对其进行制度设计和规范以符合WTO的要求。The international community pays more and more attention to environmental protection , which causes a wave of greening WTO within the WTO system.Developed countries claim to take the unilateral NPR -PPMs meas-ures in order to keep up with the trend of environmental protection.But due to the unilateralism , extraterritoriality and discrimination , the rationality of the measure is doubtful.Developing countries accuse rich countries for the re-ality of trade restrictions under environmental protection.The NPR-PPMs measure itself is rational and its negative influence mainly comes from the abuse of trade practices.In order to change the developing countries ’ misunder-standing of unilateral NPR -PPMs measures, WTO must make a design to let unilateral NPR -PPMs measures meet the requirements.
