摘　　要：遗失物适用限制善意取得制度的立法理论具有一定的不足。在当今市场经济条件下,为了市场交易迅速、高效、安全及利益平衡,遗失物应该适用善意取得。外国有关善意取得制度的规定比较成熟、完善,我国应该借鉴外国的成功的经验构建遗失物适用善意取得制度。The legislative theory on the limitation of the lost property application to the bona fide system is imperfect to some extent. Under the current market-oriented economy, the lost property should be applied to the bona fide system so as to adjust to the efficient and safe balance of the benefit of the market trade. This article proposes that the lost property should be applied to the bona fide system in our country by studying the bona fide system applied to the foreign lost property concerned.
