摘 要:礼治是先秦"天人关系"中人的因素彰显后形成的一种以礼治国的方式。先秦诸礼中,丧礼最具活力,它在形成中孕育了尊亲、爱人的人伦精神和权利义务相对应的法律思想,沟通了生养死葬之礼,具有凝聚及和睦家庭、宗族的自治功能。随着宗谱被确立为国家纲纪,服制辅助君统和分封制,确保了君统承嗣有序及边疆稳定,还推动着大宗法社会向"士农一体"化的小宗法社会过渡。先秦服制不仅为后世治亲以安邦构筑了总思路,也是涵养当代社会主义核心价值观的重要源泉。Rite-ruling is a way to rule a country with the rites, which lorrne0 alter mat me human factor revealed in the "Heaven and Human" relationship. Among all the rites, the mourning was the most dynamic, because it gave birth to the ethical spirit to respect the relatives and love others and the legal thoughts of corresponding rights and obligations, and it played roles to link up the rites from birth to death, to make the family more cohesive and harmonious and to have the clan manage themselves. As the genealogy was established as the state' s guiding principle, the mourning system, accompanied by the succession law and the enfeoffmen, guaranteed the order of the succession and the border stability, which also promoted the transition from the great patriarchal society to small patriarchal one of "unity of the shi and the peasant". The mourning system of Pre-qin Dynasty not only provided a general thought to deal with problems between relatives to keep the country stable, but also turn into an important source of the contemporary socialist core values.
