摘 要:农村宅基地和集体建设用地使用权登记的宗旨是保护权利人合法权益,必须构建宅基地和集体建设用地使用权登记的法规体系,厘清使用权登记中各类不动产单元之间的关系。宅基地和集体建设用地使用权确权登记是不动产登记的核心内容,确权登记采取权利登记方式,权属不明和疑难地块宜纳入不动产确权登记范围,农地使用权确权质量和规范是不动产登记的生命线。不动产确权登记的相关法律障碍必须突破,权属争议必须依法处置,公证导致不动产错登的必须承担赔偿责任,设立赔偿基金是应对登记错误赔偿的最佳选择。The purpose of registration in countryside homestead use right and collective construction land is to protect the rights of the legitimate rights and interests,the registration of rural homestead use right and collective construction land use right registration regulations system must be constructed to clarify all kinds of the relationship between the real estate unit in the registration of the use right. The Registration of the right to rural residential land and collective construction land use right is the core content of real estate registration. Registration of the right to take the form of rights registration management,the authority unknown and difficult block should be incorporated into the real estate registration of the right range,the right registration of right quality and standardize in use right of farmland is the lifeline of the real estate registration. The legal obstacles in real estate registration right must be broken,the ownership dispute must be disposed in accordance with the law,the wrong records of notaries cause in real estate must bear the liability of compensation,and the best choice to deal with the registration error compensation is to establish the compensation fund.
