摘 要:在《侵权责任法》实施以前,员工或雇员在执行职务过程中侵权可能会自己承担赔偿责任或者与雇主一起承担连带赔偿责任,雇主可以向雇员追偿。《侵权责任法》终结了用人单位主体的混乱,却也留下了用人单位追偿权的悬念。在职务侵权案件中,有的法院支持用人单位的追偿权,而有的法院却加以驳回。本文运用案例分析方法,认为用人单位追偿权不宜在职务侵权案件中主张,而应通过内部机制解决。Before the implementation of the "Tort Liability Law", employees may undertake the liability of reparation themselves or undertake joint responsibility for compensation with their employers when they infringe upon others" fights on their duties, and the employers can recover damages from their employees. The "Tort Liability Law" ends the confusion of the employing units, but it leaves the Suspense of the employing units'right of recovery. In the Cases of duty right infringement, some courts support employing units" right of recovery, but others dismiss their requests. This article uses the method of case analysis, believing that the employers claiming the employing units" right of recovery in the cases of duty right infringement is not suitable, they should deal with the problem through the internal mechanisms.
