公共体育服务外包的政府责任及实现机制论析

摘　　要：公共体育服务的特性决定为公众提供高质量、高效率、多层次的体育服务是政府应尽的责任。伴随我国行政改革的不断深化,外包已经成为政府提供公共体育服务的有效工具,但外包只是政府将公共体育服务的生产职能转移给社会力量,不是政府责任的推卸或让渡,而是政府责任的强化。采用文献资料法对政府责任的内涵、外包的政府责任、政府履责不力的现象及原因和政府责任的实现机制进行了研究。结果显示,除了服务资金提供、服务生产协调、服务政策法规的制定等传统责任外,公共体育服务外包的政府责任还包括外包的决策、优秀接包方的遴选、完备合同的设计和外包的监管等。当前,政府在公共体育服务外包过程中存在招标不规范或违规操作、外包服务的安排与公众体育需求错位、合同设计不完善、监管不力的履责不力现象,其归因在于"官本位"思想广泛存在、法律法规体系不健全、监督力量薄弱、外包关系复杂、行政改革的方式、既得利益、缺乏外包的技能和能力。最后,通过行政问责制、整合机制、信任机制和激励机制提出促进公共体育服务外包的政府责任的实现。The characteristics of the public sports service have determined the government＇ s necessary responsibihties to provide high-quality, high effective and multiple services to the public. With the constant deepening of administrative reform in China, outsourcing has become an effective tool for the public sports service. However, outsourcing is only a form to transfer the government＇ s production function in public sports service to non-government sectors, which is a form to strengthen the responsibility of government, not to shirk or demise the responsibility. Through documents, this paper will make a research on connotation of government responsibilities, government responsibilities in outsourcing, the phenomenon and reasons of poor implementation, and the realization of government＇s responsibilities. The results of the investigation shows that, apart from some traditional responsibilities like fund providing, service production coordinating, and policymaking, the responsibilities of government for public sports service outsourcing included decision-making, excellent outsourcing supplier selecting, outsourcing contract designing, and outsourcing supervision etc. At present, there are still some problems in current public sports service outsourcing, such as irregularities in biding or illegal operations, the mismatching between outsourcing arrangements and public sports demand, faulty design of contract, ineffective supervision and so on. All these phenomena result mainly from the extensive thoughts of ＂Mandarinate＂, the imperfect legal system, the ineffective supervision, the complex interpersonal relationships, the way of administrative reform, vested interests, and lack of skills and abilities of outsourcing. In order to realize the government responsibility in the process of public sports service outsourcing, some solutions should be taken through the administrative accountability, the mechanism of integration, trust and incentive.
