摘 要:《渔业法》和《海域使用管理法》分别规定了使用海域取得养殖证和海域使用权证的程序。在理论和实践上,通常的理解是:养殖证是行业许可证,是管"事"的;海域使用权证授予海域使用权,是确"权"的。这种"事权分离"的解释模式,为渔业和海洋行政部门都有权管理海域并征收海域使用金提供了借口,严重侵害了渔民的利益。在养殖问题上,《渔业法》与《海域使用管理法》冲突的本质是一种自然资源设定了两个分配模式,为正确处理二者冲突,应当在《海域使用管理法》中规定养殖使用海域依照《渔业法》规定办理。Fisheries Law and Administrative Law of the Use of Sea Areas respectively stipulate the procedures of obtaining the marine aquaculture license and the certificate of the right to the use of sea areas. In both theory and practice, it is commonly interpreted that the aquaculture license is the permit of the industry, primarily in charge of the permission while the certificate of the right to the use of sea areas authorizes the use of sea areas, mainly confirming the property. The interpreting mode of "permission-property separation" makes an excuse for both the administrative departments of fisheries and marine to manage the sea areas and impose the fees for the use of sea areas, which seriously infringes the interests of fishermen. In terms of the aquaculture, the conflict between Fisheries Law and Administrative Law of the Use of Sea Areas essentially results from two kinds of differ- ent distribution modes for one kind of natural resource. It is suggested to cover the stipulation that the use of sea areas for the aquaculture shall obtain the permit according to Fisheries Law in Administrative Law of the Use of Sea Areas so as to deal with the conflict properly.
