摘　　要：美国公立大学的听证制度有正式听证与非正式听证之分。正式听证建立在程序正当理念基础之上,借鉴司法审判程序来保障师生的个人利益,听证结论要根据听证记录做出。非正式听证建立在公众参与理念基础之上,意在通过灵活的机制吸纳大学的利益相关者参与到大学规则的制定过程中来,其公开、协商、评论的程序设置保障了民主参与。The hearing system of public universities in America includes formal hear- ing and informal hearing. Formal hearing bases on the theory of proper procedures, and safer guards individual interests of faculties and students by means of judicial-type procedures. What＇ s more, the conclusion should be made in accordance with the record. Informal hear- ing bases on the theory of public participation, in order to absorb the stakeholders of univer- sity to take part in the process of rulemaking. The program set in informal hearing system in- cluding openness, negotiation and review ensures democratic participation.
