检察机关自侦案件决定逮捕权上提一级的理性分析及完善构想

摘　　要：自2009年7月1日起,全国大部分地区将实施省级以下(不含省级)检察院直接受理侦查案件,由上一级检察院审查逮捕的改革。此次自侦案件决定逮捕权上提一级是基于目前自侦、自捕缺失监督,契合保障人权、程序公正诉讼法理,同时已具有现实可行性,通过完善或创新派出审查逮捕办公室、创新侦捕联动机制、赋予被逮捕犯罪嫌疑人司法复议权、提捕检察机关不捕异议审查机制、引入律师介入审查批捕新机制等措施,实现内外监督,充分发挥自侦案件决定逮捕权上提一级的制度优势。Since July 1,2009, most parts of China have implemented the reform that sub - provincial procu- ratorates （excluding the provincial level） can handle investigating cases directly, but the decision to arrest should be examined by people＇s procuratorate at the next higher level. The self investigation cases decided to arrest the fight to put on a level is based on the self investigation, supervision, lack of self trapping with protection of human fights, procedural justice to suit, also has the realistic feasibility, through the improvement or innovation, innova- tion investigation office sent arrest capture linkage mechanism, to arrest suspects the fight to judicial review, to catch the authority does not catch objection review mechanism, the lawyers involved in the review of arrest of new mechanism and other mcasures, to achieve internal and external supervision, give full play to the role of self inves- tigation cases decided to advantage of system level power of arrest.
