摘 要:航班时刻非契约条款属于国际惯例,各国航空承运人的运输总条件都有类似规定。非契约条款的效力不因航班时刻的载体类型差异而根本不同。承运人主张"合理期间"是航班时刻非契约条款合法性的直接证据,旅客则认为航班时刻非契约条款严重背离传统契约法规则,损害其合法权益。继续维持或者直接废止现有的航班时刻非契约条款都会引发灾难性后果,不利于航空运输业的整体发展。在现实条件不能满足航班完全准时离港和到港的过渡阶段,应当在保护旅客利益的前提下矫正保留航班时刻非契约条款。在航空承运人能基本左右航班离港和到港时间的终极阶段,应当明示废止航班时刻非契约条款。Flight schedule,not belonging to passenger carriage contract,is an international practice,in which similar articles drafted by air carriers have presented on general conditions of carriage. Effect of the international practice is not fundamentally different with diverse types of flight schedule. Carriers believe reasonable time is direct proof to the legality of the international practice,but customers claim it challenges the traditional contract law rules severely and invades their interest. If the current international practice is retained without any change or abolished directly,disastrous effects will outbreak during the whole development of civil aviation transport enterprise. When current conditions is not satisfied with flight time of departure from and arrival at port,it should be retained with amendment on the basis of protecting consumers’ interest. When carriers could fundamentally determine flight time of departure from and arrival at port,it should be abolished expressly.
