摘　　要：无论从规范还是实践看,台湾地区立法机构对两岸协议的审议和监督活动均遭遇了一定的现实困境。在台湾地区爆发了反对《海峡两岸服务贸易协议》的"太阳花运动"后,台湾当局行政机构提出了"两岸协议监督条例草案"。该"草案"对立法机构审议监督两岸协议的程序、方式、形式等问题做出了规定,在相当程度上代表着台湾岛内各方对两岸协议审议监督问题的共识。这一"草案"一旦获得通过将对两岸关系和平发展产生重大影响。一方面,台湾立法机构参与两岸协议监督活动的空间将逐步增大,民众了解两岸协议的渠道将得到拓展;另一方面,过分依赖两岸协议推动两岸关系和平发展的格局也将受到一定影响。Taiwan legislative body has come to some predicaments in both of its regulation and practice when reviewing and supervising the cross-Strait agreements. Right after the outbreak of the ＂Sun-flower Movement＂ aimed to fight against the sig- ning of the ＂Cross-Strait Service Trade Agreement＂, Taiwan authorities put forward the draft of the ＂Supervision regulations of the Cross-Strait Agreement＂. The draft mainly regulates the procedures, methods and forms of the legislature supervision, which, to a considerable extent, represents the consensus of all parties in Taiwan on the review and supervision of the agree- ment. It is no doubt that the adoption of the draft will exert great influence on the peaceful development of the cross-Strait rela- tions. It will not only help provide the Taiwan legislature with more opportunities to participate in the activities of the cross- Strait agreement supervision, but also enable the pepole in Taiwan to understand the agreement in more ways than before. On the other hand, the pattern in which we depend too much on the agreement to promote the peaceful development of the cross-Strait relations will also be affected in one way or another.
