大调解背景下的阿洪调解优势研究——基于宁夏阿洪调解的田野考察

摘　　要：纠纷的多元化解决机制是大势所趋。在大调解时代来临之时,宁夏具有不可比拟的本土资源,那就是阿洪调解。阿洪调解对构建和谐宁夏、法治宁夏、平安宁夏发挥了重大的作用。本文以个案的形式分析了阿洪调解的特征和式样,并在论述阿洪调解与伊斯兰教信仰的关系、阿洪调解与地方语境下回族社会控制方式的关系、阿洪调解与现行诉讼的关系中解释了阿洪调解在宁夏的优势和不足,提出应将阿洪调解进一步程序化、司法化的呼吁。The diversity of dispute settlement mechanism is the trend of the times. With the coming of the extensive mediation,Ningxia has incomparable local resource which is imam mediation. Imam mediation played an important role in construction of harmonious Ningxia,jural Ningxia and peaceful Ningxia. This paper conducted fieldwork on the characteristics and styles of imam mediation in the form of case study. It discussed the relation between imam mediation and the Islamic belief,relation between imam mediation and the way of Muslim community control with the local context,and the relation between imam mediation and current litigation. After analyzing the advantages and disadvantages of imam mediation in Ningxia,the paper proposed that the imam mediation should be there with further procedures and judicatures to make it more reasonable and well-performed.
