论黑社会性质组织犯罪没收财产刑与特别没收的适用

摘　　要：严打黑社会性质犯罪是刑事政策的共识。打黑过程中存在没收财产刑适用标准不清、违法所得认定标准模糊、犯罪工具认定过宽等问题。应当对《刑法》第五十七条进行限制解释,准确认定违法所得,严格限定犯罪工具,明确没收财产刑适用的具体标准。Crackdown on mafia - style crime is consensus of criminal policy, however, there exists some problems in the process of fighting this crime, i. e. , the applicable standard of the penalty of confiscation is unclear, the recognized standard of illegal income is fuzzy, and the affirmation of crime tool is loose. So we should take a restrictive interpretation on the article fifty - seventh of the criminal law so as to recognize illegal income accurately, strictly limit criminal tools and make clear the applicable standard of the confiscation of property punishment.
