摘　　要：印刷时期的格式出版合同沿用于OA出版,已不能成功解决著作权问题,导致补遗协议功能强化,成为作者保留关键权利的法律工具,这与合同法的原则不符。OA出版中,出版者与作者只有平等、公平地处理著作权转让问题,补遗协议的功能才能得以准确界定,内涵才能得以适当调整,才有利于作者、出版者、图书馆等使用者利益平衡。The format publishing contract in the printing period extended to OA publishing has not been able to successfully solve copyright problem. So the function of supplement agreement is strengthen and becomes legal instruments that the authors retain key rights, which does not match with the principle of contract law. For OA publishing, only publishers and authors equally, fairly treat the transfer of copyright, can the function of supplement agreement be defined, and the intention can be appropriately adjusted, which is conducive to balance of interests of the authors, publishers, libraries and other users.
