摘　　要：作为公共权力的警察权,无论是其行政执法权还是其刑事司法权,都来源于全体民众权利的让渡,这就决定了警察权的私权基础和私权保护功能。因此,警察权的行使目的是保护公民的私权利,警察权的行使应当以公民基本私权利为边界,遵循公共原则、责任原则、比例原则和程序原则。The police power, as the public power, is derived from abalienation of all the people＇s right either in terms of its administrative law enforcement power or criminal judicial power. This determines the private rights basis and private rights protection function of the police power. Accordingly, aiming at protection of the citizens＇ private rights, and bounded by citizens＇ private basic rights, the exercise of the police power should follow the principle of public, responsibility, proportion and procedure.
